1. Definitions
In this Agreement, the following terms have the meanings set out below:
- "Yonderfold", "we", "us", "our" — the business providing facilitation services, registered at 8-2 Jalan Kemuja, Bangsar Utama, 59000 Kuala Lumpur, Malaysia.
- "Services" — the facilitated session formats offered by Yonderfold: Single Fold Session, Sequenced Conversations Pack, and the Atlas Programme.
- "User", "you", "your" — any individual or family group accessing the website or engaging Yonderfold's Services.
- "Session Record" — any written agenda, minute, open-items register, document index, or chronology produced in the course of a Service.
- "Agreement" — these Terms and Conditions together with any service booking confirmation.
2. Acceptance of Terms
By accessing our website or booking a Service, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not use the website or engage our Services.
You must be at least 18 years of age and have legal capacity to enter a binding agreement. If you are booking on behalf of a family group, you represent that you have authority to bind the group to this Agreement.
3. Service Description
Yonderfold provides facilitated conversation sessions and document organisation services for families. Our Services are:
- Single Fold Session — one two-hour facilitated session with written agenda and minute (RM 495)
- Sequenced Conversations Pack — six facilitated sessions over three months with running record (RM 2,080)
- Atlas Programme — six months of facilitated sessions combined with clerical document assembly (RM 4,140)
Services are available in person at our Bangsar Utama premises and online. We serve clients primarily in Malaysia and the Klang Valley.
4. User Responsibilities
You agree to:
- Provide accurate information when making an enquiry or booking
- Attend sessions punctually or provide reasonable notice if you are unable to attend
- Treat the facilitator and other session participants with respect
- Not record sessions without the prior written consent of all participants and Yonderfold
- Not use session records for purposes beyond the family's own practical decision-making without Yonderfold's written consent
- Not use this website in any way that is unlawful, harmful, or disruptive
5. Intellectual Property
All website content (text, design, structure, methodology descriptions) is the intellectual property of Yonderfold and may not be reproduced without written permission.
Session Records produced in the course of the Services belong to the family. Yonderfold retains no ongoing rights to the content of those records. The facilitation methodology and templates used to produce those records remain Yonderfold's property.
6. Payment Terms
All fees are quoted and payable in Malaysian Ringgit (RM). Payment is due in full prior to the first session of any engagement. We accept bank transfer and selected digital payment methods; details are provided in the booking confirmation.
Rescheduling: Sessions may be rescheduled with at least 48 hours' notice at no charge. Rescheduling with less than 48 hours' notice may incur a rescheduling fee of RM 100 per session.
Cancellations: Cancellation more than 7 days before the first session entitles you to a full refund minus a RM 50 administrative fee. Cancellation within 7 days of the first session is non-refundable. For multi-session programmes, cancellation after the first session has taken place will be assessed on a pro-rata basis at Yonderfold's discretion.
7. Service-Specific Terms
Scope: Yonderfold provides facilitation and document organisation services only. We do not provide legal, financial, medical, therapeutic, or any other regulated professional advice. Nothing produced in our sessions constitutes advice, and no session record has any formal legal standing.
Scope changes: If the scope of a multi-session engagement changes materially from what was agreed at booking, we will discuss revised terms with you before proceeding.
Documents in the Atlas Programme: Documents you provide to Yonderfold for assembly remain your property throughout. We return all originals (or copies, as agreed) in the bound handover pack at programme completion. We do not retain copies after handover.
8. Disclaimers
The Services are provided on an "as is" basis. Yonderfold does not represent that a session will produce any particular outcome, resolve any dispute, or result in any specific family decision.
The website is provided for information purposes only. Yonderfold does not warrant the accuracy or completeness of any third-party practitioner directory included in our materials.
9. Limitation of Liability
To the maximum extent permitted by Malaysian law, Yonderfold's total liability for any claim arising from the Services shall not exceed the fees paid for the specific engagement to which the claim relates.
Yonderfold shall not be liable for indirect, consequential, special, or punitive damages, or for any loss resulting from reliance on information in a session record. This limitation applies regardless of the form of the claim.
10. Indemnification
You agree to indemnify and hold harmless Yonderfold, its facilitators, and staff from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of this Agreement, your misuse of session records, or any claims brought by third parties in connection with your engagement of our Services.
11. Termination
Either party may terminate a multi-session engagement by written notice. Yonderfold reserves the right to terminate immediately if a participant's conduct makes it impractical or unsafe to continue. In such cases, fees for completed sessions are non-refundable.
Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.
12. Dispute Resolution
This Agreement is governed by the laws of Malaysia. The parties agree to attempt to resolve any dispute informally in the first instance by written communication to [email protected]. If the dispute is not resolved within 30 days of that notice, either party may refer the matter to the courts of Kuala Lumpur, Malaysia.
13. General Provisions
- Entire agreement: This Agreement constitutes the entire agreement between the parties in relation to its subject matter and supersedes all prior agreements and representations.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it later.
- Assignment: You may not assign your rights under this Agreement without Yonderfold's written consent. We may assign our rights to a successor business.
- Notices: Notices under this Agreement should be sent to [email protected].
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via a notice on our website homepage at least 30 days before taking effect. Continued use of our Services after that date constitutes acceptance of the revised Terms.
